Terms of Use
Version: terms-2026-10-16 · Updated 16 October 2026 · Provider: Reimund Bleischwiz, Eberhard-Hoesch-Strasse 130, 52351 Düren, Germany (see Imprint)
The German text is the original. This translation is provided for convenience; where the two differ, the German version applies.
These terms apply between you and the provider for the use of the Flukto app and the website flukto.com. They are short and written in plain language. Where something sounds legal, it is there because it has to be.
1. What Flukto is
Flukto is a local chat. You say one line, and people near you can see it and answer. No phone number, no contact list, nobody to add first.
Everything here is short-lived, and that is the point, not a shortcoming:
- A session on air runs for four hours and then ends by itself. You can extend it as often as you like — four fresh hours each time — and you can stop it at once, whenever you want.
- A first message to someone you have not talked to yet lives for one hour; two if the person is not on air right now or is in your friends list. Unanswered, it dies.
- A chat dissolves 24 hours after the last message, a group 7 days after the last message or join — on all sides, completely. There is no archive.
Full reach, visiting other cities (your session then stands as a "Guest" in a distant cell), groups and the friends list are open to every account from the first start; nothing has to be earned. Translating other people's lines is done by a model on our server and can be inaccurate — the original text is always what counts.
Flukto is free. No advertising, no in-app purchases, no selling of data.
2. Who may take part
You must be at least 18 years old. If we learn that an account belongs to someone younger, it is blocked and deleted.
You create one account and use it yourself. You do not pretend to be someone else, neither by name nor by photo.
Access is passwordless: either a code sent to your e-mail address, or sign-in with Google (Android) or Apple (iPhone). Keep that mailbox or account safe — whoever gets in there gets into your Flukto account.
3. What you get from us — and what you do not
We do our best to keep Flukto running. We do not promise availability: there can be maintenance, there can be failures, and we may discontinue the service. If we do, we will say so in the app at least 30 days in advance.
We do not promise that you will meet anyone, that anyone will answer, or that the people you see here have been checked in any way. We do not verify identities. A name and a photo are a claim, not a fact.
4. If you meet someone
That is the whole point of the app, and also the part where you have to watch out for yourself. Meet in public places. Tell someone where you are. And walk away the moment something feels wrong — you owe nobody an explanation.
A meeting happens at your own risk. We are not there, we do not know these people, and we cannot answer for what happens.
5. Your position
Flukto never shows anyone your exact location. What they see is a grid point: a fixed spot in the grid cell you are standing in. The cell is at least 300 metres wide and everyone sees the same spot, so many looks cannot be turned into an exact position. Distances shown are rounded. There is no exception — not with your consent, not in a chat.
A meeting point you set yourself inside a chat is a different thing: that is a place you name on purpose. It dies with the chat.
Without location permission you cannot go on air. The map, the World view and notes can still be read. You can withdraw the permission in your operating system at any time.
6. What you do not do here
The Community Guidelines are part of these terms. In short: no harassment, no hate, no sexual content, no advertising, no other people's data, nothing illegal.
Flukto has no tolerance for objectionable content or abusive users. Harassment, threats, hate, sexual content, spam and the posting of other people's data lead to the content being removed and the account being terminated.
Technically, also: no automated access, no bots, no scraping, no circumventing blocks, no attacks on the service. The public map on flukto.com may be viewed and linked, but not queried automatically.
Stickers from flukto.com go only where that is allowed — on your own things or with the owner's permission. For stickers on other people's property or in public space without permission, you are responsible yourself.
Groups: whoever creates a group is responsible for its title and its members and can take back any line in it. Whoever is invited may decline or leave at any time.
7. What happens to your content
Your photos, your line, your messages, polls and sticker texts are yours. So that Flukto can show them, you grant us the simple right to store them, check them, translate them at a reader's request and show them to the people they are meant for — limited to operating the app, and limited to the lifetime of that particular content. Delete it, or let it expire, and that right ends. In a group your lines stay after you leave until the group ends, because they are part of the others' conversation.
You warrant that you hold the rights to what you upload, and that no other people appear in it who would object.
8. When rules are broken
Depending on severity: a note, hiding a piece of content, a temporary block, a permanent block. Where there is obvious danger to others, we act immediately.
When we hide content, refuse a photo or restrict an account, we tell you in the Team thread what we did and why (Art. 17 DSA). Exception: where the law requires silence.
We review every report within 24 hours. Content that breaks these terms is removed and the account that posted it is terminated. The person reported does not learn who reported them.
If you think a block was wrong, write to us in the app's Team thread or to the address in the Imprint. We will look again.
9. Ending it
You can stop at any time: "Delete account" in the app. It takes effect immediately and completely; there is no waiting period and no undo.
We may block or delete an account if these terms or the Community Guidelines are seriously or repeatedly broken.
10. Liability
First things first: liability always requires that WE did something wrong. We are not liable for what other people do — in a chat or at a meeting; we are not part of that encounter. What follows are the legal limits of our own responsibility, not the assumption of someone else's.
We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health. German law does not allow that liability to be excluded (§ 309 no. 7 BGB) — but it only means that we answer for our own breaches of duty.
For ordinary negligence we are liable only for breaching an obligation whose fulfilment makes proper use possible in the first place and on whose observance you may rely — and then limited to the typical, foreseeable damage.
Otherwise liability is excluded. Liability under the German Product Liability Act remains unaffected.
Since Flukto is free, the following also applies: for loss of data we are liable only within the limits above. Content that expires by design is not data loss, it is the promised function.
11. Changes to these terms
If we change something that affects your rights or duties, the text gets a new version. At the next start the app shows you what changed and asks you again. Without your agreement you cannot keep using Flukto — your account stays, and you can delete it.
Fixing a typo does not change the version.
12. Law and jurisdiction
German law applies. Mandatory consumer protection rules of your country of residence remain unaffected.
13. Final clauses
If a provision is invalid, the rest stays valid. There are no side agreements; what applies is in these terms, the Community Guidelines and the Privacy Policy.
